Welcome to Motako Software. By accessing our website (the "Site") or purchasing our products and services, you agree to be bound by the following Terms and Conditions. Please read them carefully.

1. Definitions

  • "Motako Software" refers to the business, its owners, and employees.
  • "Products" refers to 3D models, pre-built games, and mobile applications sold on the digital storefront.
  • "Services" refers to custom software development, consulting, and design work.
  • "User" or "Client" refers to anyone accessing the site or purchasing from us.

2. Digital Storefront & Licensing

All digital products sold on the Motako Software Storefront are subject to the following:

  • License Grant: Unless otherwise stated, a purchase grants you a non-exclusive, non-transferable license to use the asset in your own projects (commercial or personal).
  • Restrictions: You may not resell, redistribute, or sub-license the raw source files (e.g., .blend, .fbx, or source code) as standalone assets.

  • Delivery: Digital products are delivered via download link immediately upon successful payment. Motako Software is not responsible for download issues related to the user's internet connection.

3. Custom Software & Services

For custom projects (Desktop Apps, Mobile Apps, Custom Games):


Proposals:

  • All quotes provided are valid for 30 days.
  • Payment Terms: A non-refundable deposit (typically 50%) is required before work commences. Remaining balances are due upon milestone completion or final delivery.
  • Client Review: The client has 30 business days to review deliverables. If no feedback is provided within this window, the work is deemed accepted.
  • IP Ownership: Intellectual Property (IP) rights to custom-built software are transferred to the Client only upon full and final payment. Motako Software retains the right to showcase the work in its portfolio unless a Non-Disclosure Agreement (NDA) states otherwise.

4. Refund & Cancellation Policy

  • Digital Products: Due to the nature of digital goods, all sales are final. No refunds will be issued once a download has been initiated, except in cases of technical corruption of the file that cannot be resolved by our support team.
  • Services: If a custom project is cancelled by the Client, Motako Software will be compensated for all work completed up to the date of cancellation.

5. Limitation of Liability

Motako Software provides software and assets "as-is" without any warranty of any kind, either express or implied.

  • We do not guarantee that our software will be compatible with all hardware or future OS updates.
  • In no event shall Motako Software be liable for any indirect, incidental, or consequential damages (including loss of data or profit) arising out of the use or inability to use our products.

6. User Conduct

By using our Site, you agree not to:

  • Attempt to reverse-engineer or "scrape" the Site’s content.
  • Use our 3D assets to train generative AI models without explicit written permission.
  • Upload malicious code or attempt to breach our security systems.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Botswana/Gaborone. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts in Gaborone/Botswana.

8. Changes to Terms

Motako Software reserves the right to modify these terms at any time. We will notify users of any significant changes by posting a notice on our homepage or via email.
